Terms of use

Terms governing the use of tmsped.com and the contact form. This document is the English-language reference; the binding version, in case of doubt, is the Polish Regulamin.

§ 1. General provisions

  1. These terms govern the use of the website at tmsped.com and the contact form available on the site.
  2. The service provider is Piotr Kukuć, a Polish sole proprietor registered in CEIDG, with place of business at ul. Ludowa 52, 68-200 Żary, Poland, NIP 9282118288, REGON 543303562 — operating under the trade name Tmsped, hereinafter “Tmsped” or the “Provider”.
  3. The Provider’s Polish e-Delivery address: AE:PL-84407-34139-WJIJB-20.
  4. The terms are made available free of charge at tmsped.com/en/terms in a manner allowing them to be obtained, displayed and saved.

§ 2. Definitions

  • Site — the website in the tmsped.com domain.
  • User — a natural person or business visiting the Site.
  • Form — the contact form for sending an enquiry.
  • Service — making the Site’s content available and replying to enquiries sent via the Form.

§ 3. Type of services

  1. Tmsped provides the following electronic services free of charge: making informational content about its offering available, and operating the contact Form.
  2. Using the Site and the Form does not require account registration.
  3. These terms do not govern the implementation or maintenance of the Tmsped TMS — those services are subject to separate agreements with clients.

§ 4. Technical requirements

  1. Use of the Site requires a device with internet access and a browser supporting HTML5, CSS3 and JavaScript.
  2. Submitting the Form requires an active email address.

§ 5. Use of the Form

  1. Submitting the Form is voluntary and free of charge.
  2. The User must provide truthful information.
  3. Tmsped replies to enquiries within a reasonable time, usually a few business days.
  4. Tmsped may decline to reply to enquiries containing unlawful, abusive or spam content.

§ 6. No unlawful content

The User must not provide unlawful content, including content infringing personal rights, copyright, industrial-property rights or data-protection laws.

§ 7. Complaints

  1. Complaints regarding the operation of the Site or the electronic services should be sent to contact@tmsped.com.
  2. A complaint should include: contact details, a description of the issue and the requested resolution.
  3. Tmsped considers complaints within 14 days of receipt and informs the User of the outcome via the same channel.

§ 8. Personal data

The processing of personal data is described in our Privacy policy.

§ 9. Out-of-court dispute resolution

Consumers may use out-of-court dispute-resolution methods, including the European Commission’s ODR platform at ec.europa.eu/consumers/odr.

§ 10. Final provisions

  1. Tmsped reserves the right to amend the terms for valid reasons (changes in law, scope of services). Material changes will be announced on the Site at least 7 days in advance.
  2. Matters not regulated here are governed by Polish law, including the Civil Code, the Act on the Provision of Services by Electronic Means and GDPR.
